FOURBYSIX

Terms of Use

These terms

These terms are an agreement between you and Crystal Bay Creative, LLC, which operates FourBySix (“we”, “us”). They apply when you use www.fourbysix.co, order prints from our shop or from a community print shop (an address ending in 4x6.photos), open a photo page at my.fourbysix.co, or send us orders through our API. By placing an order or using the API you agree to them. Our Privacy Policy explains what we do with your information and is part of these terms.

You need to be at least 13 to use the shop. If you are under 18, you need a parent or guardian’s permission to place an order, and they agree to these terms on your behalf.

What we do

We take photos, enhance them, print them on 4×6 matte paper, and mail them. In the shop, you choose photos, frame them, pay, and we post the prints to you. We also print photos and postcards for other companies’ apps, which send us their customers’ orders through our API.

We may change, pause or stop parts of the service. If we stop taking orders, we will still finish or refund the ones you have paid for.

Community print shops

We also run print shops for schools, clubs, teams and other groups, each at its own address ending in 4x6.photos. When you buy from one you are buying from us, under these terms, and the group earns a share of the sale. That share is the group’s income from the sale, not a donation, so your purchase is not tax-deductible.

  • The price per print is the one shown in that shop, and delivery to the group is free.
  • If you choose delivery to the group, you give us the name to put on the envelope and the place it should go, such as a classroom. We deliver it to the group with that shop’s other orders, and the group hands it out (see Delivery).
  • Discount codes for our own shop can’t be used in a community print shop.

Your photos

Your photos stay yours. We don’t claim any ownership of them.

To do the job, you give us permission to store, copy, enhance, crop, print and mail your photos; to design the back of each print from the information inside the photo file; for orders from our shop, to offer the photo file you uploaded on its photo page (below); to photograph postcards before mailing them and share those photographs with the company that ordered them; and to keep copies as our Privacy Policy describes. That permission is worldwide and free of charge, and it is only for providing and supporting the service — we will not use your photos to advertise, sell them, or let anyone else use them. It ends when the photos are deleted from our systems, except for prints already made and copies we must keep by law.

When you send us a photo, you promise that:

  • you took it, own it, or have permission to have it printed;
  • the people recognisable in it would be comfortable with it being printed and posted — and if any of them are children, that you are their parent or guardian or have that person’s permission;
  • printing and mailing it doesn’t break any law or anyone else’s rights.

What you can’t send

We will not print, and you may not send:

  • sexual content involving anyone under 18 — we report it to the National Center for Missing & Exploited Children and to law enforcement;
  • intimate images of anyone who hasn’t agreed to them being shared;
  • material that infringes someone else’s copyright, trademark or other rights;
  • threats, harassment, or material meant to intimidate the person it is mailed to;
  • anything else that is illegal to make or to send through the post.

We don’t look through orders as a matter of course, but the people who print and pack them do see them. We can refuse or cancel any order we believe breaks these rules, and if we do we will refund it, unless the law requires otherwise.

The back, and the QR code

The back of each photo print is designed from the photo’s own data. Where the file has it, the back shows a map marking where the photo was taken, the place name, the latitude and longitude, and the date and time. Anyone holding the print can read it. If you don’t want that on a print, remove the location from the photo before you upload it. Postcard backs are printed exactly as the sender designed them.

Every print from our shop carries a QR code that opens a page showing that photo, which anyone with the print or the link can view and download, as the original file you uploaded, with whatever location and camera details are stored inside it. Please give prints only to people you are happy to have that photo. We keep that page working until you ask us to delete the photo, which you can do at any time; it is a courtesy rather than a guarantee, so please keep your own copies. Prints ordered through another company’s app carry that company’s QR code, if any, leading to its own page.

Ordering and paying

  • Prices are shown in the shop before you pay, in US dollars: a price per print, plus a flat delivery charge for an order we post.
  • Tax, where it applies, is calculated from the address you give at checkout and shown before you pay.
  • Payment is handled by Stripe, through the payment form on our checkout page. We never see or store your card number.
  • Your order is placed once Stripe confirms the payment. We will show you a confirmation and email you one.
  • We start straight away — your photos are collected for printing within moments of payment — so an order can’t be changed or cancelled once it is paid. Check your photos, framing and delivery details before you pay.
  • If you leave checkout without paying, your photos go back in your basket and nothing is charged.

Print quality and colour

Every photo is enhanced automatically before it is printed — exposure, colour, sharpness and noise — because that is what makes a phone photo look its best on paper. That is the product, and it means a print will not be identical to the file you sent.

  • Colour on paper is not colour on a screen. Screens give off light and paper reflects it, so a print will always look somewhat different from your phone. That isn’t a defect.
  • A 4×6 print is a 3:2 shape. Most phone photos are 4:3, so some of each photo is trimmed. You can choose what is kept; if you don’t, we keep the middle.
  • Small or heavily compressed photos may print soft. We print what you send.
  • We print and cut on real equipment, so allow for small variations in trimming and alignment.

Delivery

We currently deliver to addresses in the United States only. Orders are posted with the United States Postal Service; any delivery time we mention is an estimate, not a promise. Please make sure the address you give at checkout is right — we post to exactly what you enter.

If your prints haven’t arrived when you expected them, or arrive damaged, email us and we will work out with you how to put it right. Prints are yours once they are delivered to the address you gave us; until then, a package lost or damaged in the post is our problem, not yours.

In a community print shop you can instead have an order delivered to the group. We deliver it with that shop’s other orders, in an envelope labelled with the name and place you give us, and the group hands it out. Any delivery day or order cut-off the shop shows is our aim, not a promise. Your prints are delivered once we hand them to the group; if an envelope doesn’t reach the person it was for, email us and we will put it right.

Refunds

Some problems we can see for ourselves, and we fix those without being asked:

  • If we can’t make any of your order — for example, your photos couldn’t be retrieved or processed — we refund the whole order, delivery and tax included.
  • If some of your photos can’t be printed but the rest can, we post the ones that worked and refund the prints that didn’t. Delivery isn’t refunded in that case, because the package still went out.

Refunds go back to the card or wallet you paid with. Your bank may take a few days to show them.

For anything else — a print that came out wrong, or a problem in the post — email [email protected] soon after delivery, with a photo of the problem if you can, and we will make it right — usually by reprinting it, or by refunding it if a reprint won’t help. Because every order is made to order from your own photos, we can’t accept returns for a change of mind.

Nothing here takes away any right you have under consumer law.

Partners and the API

If you are a business sending orders to us through our API, these terms apply to you too, together with the Partner API documentation and any separate agreement we have made with you, which wins where it differs. In addition:

  • Your customers. You are responsible for what you send us and for having the right to send it. That includes telling your customers — in your own terms and privacy policy — that their photos and addresses go to us to be printed and mailed, that the back of a photo print shows where and when it was taken, and, if you send a qr_url, that the print carries a code to your page that anyone holding it can open. The rules in Your photos and What you can’t send apply to everything you send.
  • We print what you send. A postcard’s back is your artwork, printed as it arrives; we add nothing to it, so the address must be on it. A photo print’s back carries our name and, if agreed, yours.
  • We host nothing for you. A QR code on a back leads only to a page of yours. We delete every image in an order 30 days after it is mailed. You already have the originals you sent us; serve your page from those.
  • Source links expire. As the documentation explains, we fetch each image as soon as an order arrives. If a link has already expired, that item fails and the order stops; you resubmit it under a new reference.
  • Postcard photographs. If you ask for them, we send photographs of each finished postcard to your endpoint. Treat them as your customer’s personal information: they show the address. We delete our copies with the rest of the order, 30 days after it is mailed.
  • Keys. Your API key is issued to you by a person and is yours to keep secret. You are responsible for orders placed with it. Tell us at once if it leaks, and we will replace it.
  • Fair use. Stay within the limits we set for your account, and don’t use the API to probe, overload or get around our systems. We may suspend a key that is misused or puts the service at risk, and we will tell you why.
  • Fees. What we charge you, and how, is agreed with you separately.
  • Data. We process your customers’ information on your behalf, only to fulfil your orders, as our Privacy Policy describes. If you need a data processing agreement, ask and we will put one in place.

Our side of things

The site, the shop, the design of the printed back and the FourBySix name are ours. You may link to us and share your photo pages, but please don’t copy the site or use our name in a way that suggests we endorse you.

We may suspend or close access for anyone who breaks these terms. You can stop using the service at any time, and ask us to delete your information as the Privacy Policy describes.

Disclaimers and liability

We take care with every order, but the service is provided “as is”. To the extent the law allows, we don’t promise that it will always be available or free of errors, and we make no other warranties beyond the ones in these terms.

To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of data or of sentimental value — please keep your own copies of your photos, because a print or a stored copy is not a backup. Our total liability to you for any order is limited to what you paid for that order, and otherwise to what you have paid us in the twelve months before the claim.

If you break these terms or send us photos you had no right to send, and someone makes a claim against us because of it, you agree to cover our reasonable costs of dealing with it.

Some places don’t allow some of these limits, so they may not all apply to you. Nothing here limits liability that can’t legally be limited.

Disputes

If something has gone wrong, please email us first — most things can be put right quickly. These terms are governed by the laws of the Commonwealth of Pennsylvania, and disputes will be heard in the state or federal courts for Montgomery County, Pennsylvania. Either of us may instead bring a claim in small claims court where it qualifies. If you are a consumer, this does not take away the protection of the laws of the place where you live.

Changes

We may update these terms. The version in force when you place an order applies to that order. If we make a significant change we will say so on the site before it takes effect.
